The U.S. Supreme Court
recently ruled that the public is entitled to and should learn about misconduct
by judges when they are running for re-election. An examination of only a few
instances expressly indicates that Judge Judy Hayes record is strewn with
malicious and incompetent misconduct. A few of her misconduct actions as
follows.
One man (Joe, not his real name)
informed me of his abuse and observations in Judge Hayes' court. His neighbor,
who was offering his house for sale, filed a complaint that Joe was parking his
Tractor Trailer (engine) Rig in Joe's own driveway and Judge Hayes fined him
$650. Joe was not aware of any law forbidding parking his own rig in his own
driveway and should have only received a warning or at most a very small fine.
Joe observed that Judge Hayes levied a fine of $650 against a man for doing some
clearing with a tractor on his own 40 acre farm. Joe observed that Judge Hayes
levied fines of $300 to $500 against several other people who were charged with
similar activities, which were also unusually excessive and
illegal.
Another man, Tony Zizza, informs
me that he and his wife have been ripped off, as a plaintiff and as a defendant,
in several ways by Judge Hayes. I have 8 pages of Tony's details of Hayes
misconduct against him and his efforts to obtain justice.
I was personally the victim of a huge
conspiracy and obstruction of justice (Felony Crimes) by Judge Hayes, along with
co-conspirators, Judge Arch McGarity, District Attorney Tommy Floyd, Former
Police Chief Jimmy Mercer, and Home Builder Sonny
Strickland.
Ralph Otis Hanes, formerly
Ola Community, was arrested and prosecuted for soliciting and receiving orders
for cabinets he planned to steal from me and delivering one set of cabinets to
Sonny Strickland, which he stole from me. Tommy Floyd refused to prosecute Hanes
for other cabinets stolen from me and refused to prosecute Strickland for
Theft By Receiving, as required by law,
O.C.G.A. 16-8-7, and
incorrectly convincing me to sue Strickland in civil court. Judge McGarity
refused to order Strickland to allow me to examine Strickland's records to
determine how many sets of cabinets he purchased from Hanes that were stolen
from me. Mercer refused to allow an investigation and my later personal
incomplete investigation eventually revealed approximately 5 sets of cabinets
purchased by Strickland that were stolen from me. Judge Hayes refused to issue
an arrest warrant against Strickland for
Theft By Receiving and
Theft
Conspiracy, both felony crimes. Judge Hayes refused to issue an arrest
warrant against Hanes for a set of cabinets he stole and sold to Guy Reagan,
also a felony crime.
While I was, waiting
my turn, attempting to obtain the aforesaid arrest warrants, approximately 8
people had been arrested for
Deposit Account Fraud (Bad Checks)
O.C.G.A. 16-9-20. Without any explanation of the law, she asked each one
"How do you plead". Each one said "Guilty" because they had written the checks.
Most likely, some of them were not guilty of a crime due to writing their check
because of a bookkeeping error or in payment on a charge account, neither of
which would be a law violation crime. Judge Hayes maliciously incorrectly gave
each person a criminal record when most likely some of them had not committed a
crime.
On another occasion one man was
illegally and erroneously arrested and placed in jail for writing a check in
payment on a charge account and the check was insufficient due to a bookkeeping
error. The arrest occurred while he was on the way with cash to replace the
check. Hayes levied an illegal fine of $500.00 to dismiss the charge, which was
intentional criminal theft by Judge Hayes (she has immunity). The man was not
aware of the legal technicalities or he would have instituted a lawsuit for
"False Arrest" against the company that requested the
arrest.
Judy Hayes has bragged about
collecting approximately $1,000,000 last year in fines and restitution. I have
never heard of anyone who received any restitution from Judge Hayes. She
compared this to $44,000 she collected her first year in office. Henry County
population has almost tripled since her first term as Magistrate Judge. Triple
$44,000 equals $132,000. This means she has rampantly and maliciously gone wild
with levying fines without justification, flagrant misconduct, abuse of justice,
false arrests, obstruction of justice, favoritism,
etc.
Our current enforcement laws allow
judges to rip you off with absolute immunity and many judges think they have
been elected or appointed God. Our oversight commission, Judicial Qualification
Commission, is a case of foxes guarding the hen house and they can put you in
jail if you file a complaint against a judge and tell anyone that you filed the
complaint.
The reason you have not been
hearing about judicial misconduct is that our current laws have prevented
judicial candidates from exposing incumbent judicial misconduct. This law has just been
declared unconstitutional by the U.S Supreme Court but Georgia's Judicial
Qualification Commission has refused to allow candidates to expose crooked
judges until after November 5, 2002.
Also, most lawyers running against an
incumbent judge are afraid of the consequences if he or she loses and has to
appear before the crooked judge after the election.
Furthermore, the news media
does not keep a watch on judges except on high profile cases, and probably never
observe district attorneys lying to grand juries, obstructing justice for "Friends" or manipulating them into illegal indictments for notches on their belt.
Our judicial system desperately needs
correcting. Judy Hayes is not fit to be a judge of anything and needs to be
removed from office. The people of Henry County, Georgia, deserve an honest
Magistrate Judge.
